<p class="wp-block-paragraph">ANNEX I – GLOSSARY OF HEGEMONIC AND EUROPEAN POLITICAL LANGUAGE</p>



<p class="wp-block-paragraph"><strong>Introduction</strong></p>



<p class="wp-block-paragraph">Over the past three decades since the Dayton Peace Agreement, political language in Bosnia and Herzegovina has significantly shaped political practice and institutional arrangements. However, rather than consistently contributing to legal clarity, democratic deliberation, and institutional coherence, political language has often reflected and reinforced ethnopolitical narratives and practices. These have led to institutional stalemate, parallel decision-making structures, and limited state functioning.</p>



<p class="wp-block-paragraph">As a result, key political and constitutional concepts have gradually diverged from their established meanings within the European legal and political framework. This has led to ambiguities in interpretations and competing conceptual understandings, affecting institutional performance, public administration, and the state’s capacity to function in accordance with democratic governance, the rule of law, and civic equality.</p>



<p class="wp-block-paragraph">To address these challenges, this glossary provides a structured analytical overview of frequently used political terms in public discourse and institutional practice. Its purpose is to distinguish between concepts shaped by hegemonic or particularistic interpretations and those founded on European constitutional standards and international legal norms. By treating political language as an integral element of institutional practice, the glossary highlights its direct implications for policy formulation, institutional interaction, and the implementation of reforms.</p>



<p class="wp-block-paragraph">Each of the seventy-one terms in the glossary is examined through five analytical dimensions: prevailing hegemonic interpretation, function within existing power structures, European and international legal meaning, institutional and political consequences of inconsistent or politicised usage, and proposed use in line with democratic and European standards. This approach ensures greater conceptual consistency and contributes to a clearer understanding of how terminology influences institutional behaviour and reform processes.</p>



<p class="wp-block-paragraph">Aligning political language with European standards is a crucial supporting element to Bosnia and Herzegovina’s broader reform agenda. In this context the glossary should be understood as serving as a complementary analytical tool, facilitating institutional dialogue, supporting policy coherence, and contributing to a shared conceptual framework relevant for European integration processes. It is intended to assist policymakers, institutions, and stakeholders in identifying terminological inconsistencies and promoting the use of language compatible with the principles and practices of the European Union.</p>



<p class="wp-block-paragraph">1. <strong>Constituent peoples</strong></p>



<p class="wp-block-paragraph"><strong>Hegemonic meaning</strong>: Reframed as sovereign ethnic groups with political rights that supersede those of the state and its citizens.</p>



<p class="wp-block-paragraph"><strong>Function in the power structure: </strong>Transforms ethnic elites into quasi-sovereign actors; enables their vetoes, territorial claims, and institutional blockades.</p>



<p class="wp-block-paragraph"><strong>European/international meaning: </strong>A historical–cultural category with no sovereign political authority; sovereignty belongs exclusively to the state and its citizens.</p>



<p class="wp-block-paragraph"><strong>Consequences</strong>: Eliminates equality of citizens; undermines state unity; legitimises ethnic oligopolies.</p>



<p class="wp-block-paragraph"><strong>Use as proposed in line with democratic standards:</strong> ‘citizens’ and ‘political nation’ as rightful holders of political rights.</p>



<p class="wp-block-paragraph">2. <strong>Constitutive (Konstitutivan) </strong><strong>—</strong><strong> used to legitimise power of veto and ethnic entitlement</strong></p>



<p class="wp-block-paragraph"><strong>Hegemonic meaning</strong>: Defined as a political status granting collective veto power and territorial entitlement.</p>



<p class="wp-block-paragraph"><strong>Function in the power structure</strong>: Blocks institutions and enables ethnic elites to override democratic processes.</p>



<p class="wp-block-paragraph"><strong>European/international meaning</strong>: Describes historical participation in forming a Constitution — not a source of sovereignty.</p>



<p class="wp-block-paragraph"><strong>Consequences</strong>: Used to justify narratives of partition.&nbsp;</p>



<p class="wp-block-paragraph"><strong>Use as proposed in line with democratic standards: </strong>Using it only as a historical descriptor, not as a term marking&nbsp; ‘constitutional power’.</p>



<p class="wp-block-paragraph">3. <strong>People (narod) &#8211; (Narod) </strong><strong>—</strong><strong> term misused to</strong><strong> replace citizens by ethnic collectivities</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: Used as a synonym for “nation,” making it possible for ethnic groups to claim state-level authority.</p>



<p class="wp-block-paragraph">Function in the power structure: Replaces citizens by ‘ethnic collectivities’.</p>



<p class="wp-block-paragraph">European/international meaning: ‘People’ refers to the citizens as a whole, and not an ethnic group.</p>



<p class="wp-block-paragraph">Consequences: Delegitimises state institutions.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Using ‘citizens,’ ‘population,’ or ‘electorate’ instead.</p>



<p class="wp-block-paragraph">4. <strong>Nation (Nacija) </strong><strong>—</strong><strong> reduced to ethnicity instead of political community</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: Reduced to ethnicity; excludes those who do not belong to the dominant ethnic group.</p>



<p class="wp-block-paragraph">Function in the power structures: Turns the state into an ethnic property.</p>



<p class="wp-block-paragraph">European/international meaning: The political community of citizens.</p>



<p class="wp-block-paragraph">Consequences: Destroys civic identity; creates a divided politics.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Nation = all citizens of Bosnia and Herzegovina.</p>



<p class="wp-block-paragraph">5. <strong>Territory belonging to a people </strong><strong>—</strong><strong> part of the state territory claimed by an ethnic group to be their own</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: Presents territory as an ethnic property.</p>



<p class="wp-block-paragraph">Function in the power structure: Supports secession, partition, and irredentism.</p>



<p class="wp-block-paragraph">European/imyernational meaning: Territory belongs exclusively to the state.</p>



<p class="wp-block-paragraph">Consequences: Creates proto-state ethnic zones.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Using ‘state territory’ or ‘administrative units’ instead.</p>



<p class="wp-block-paragraph">6. <strong>Vital national interest &#8211; an ethnic mechanism disguised as a tool for protection.</strong> Hegemonic meaning: A tool for exercising an ethnic veto to stop political decisions from being made.</p>



<p class="wp-block-paragraph">Function in the power structure: Enabling political elites to block any state institution or law from being passed.</p>



<p class="wp-block-paragraph">European/international meaning: Protection of minorities that is narrowly defined and based on individual rights.</p>



<p class="wp-block-paragraph">Consequences: Institutional paralysis.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Limiting it to genuine protection of human rights.</p>



<p class="wp-block-paragraph">7, <strong>Legitimate Representation </strong><strong>—</strong><strong> doctrine claiming only ethnic members may represent </strong><strong>‘</strong><strong>their people</strong><strong>’</strong><strong></strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: A representative is only ‘legitimate’ if they belong to a certain ethnic group.</p>



<p class="wp-block-paragraph">Function in the power structure: Removes democratic legitimacy; Ethnic elites retain monopoly over the political functions.&nbsp;&nbsp;&nbsp;</p>



<p class="wp-block-paragraph">Consequences: Destroys political pluralism.</p>

<p class="wp-block-paragraph">Function in the power structures: Delegitimises sovereignty; promotes the idea of Bosnia as a state created by an “agreement made by three ethnic groups.”&nbsp;</p>



<p class="wp-block-paragraph">European/internationalmeaning: A state is never constituted by three or more ethnic groups, but by its citizens. Consequences: Blocks constitutional and institutional reforms.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Using ‘three ethnic groups’ where relevant; reserve the term ‘nation’ for the state only.</p>

<p class="wp-block-paragraph">Hegemonic meaning: Used as shorthand for an allegedly hegemonic Bosniak political center.</p>



<p class="wp-block-paragraph">Function in the power structures: Delegitimises state institutions by portraying them as instruments of one ethnic group.</p>



<p class="wp-block-paragraph">European/international meaning: Capitals represent the state, not an ethnic bloc.</p>



<p class="wp-block-paragraph">Consequences: Weakens trust in state authority.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Using “state institutions in Sarajevo”.</p>



<p class="wp-block-paragraph">64. <strong>Legitimate Representation (extended misuse) </strong><strong>—</strong><strong> redefining legitimacy through ethnic belonging</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: Claims that only an ethnically “authentic” representative can legitimately represent their group.</p>



<p class="wp-block-paragraph">Function in the power structures: Disenfranchises citizens and blocks political pluralism.</p>



<p class="wp-block-paragraph">European/international meaning: Legitimacy arises from elections and equal rights of all to vote.</p>



<p class="wp-block-paragraph">Consequences: Counters democratic principles and ECHR rulings.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Using “elected representative”.</p>



<p class="wp-block-paragraph">65. <strong>‘</strong><strong>Joint Institutions of BiH</strong><strong>’</strong><strong> </strong><strong>—</strong><strong> misleading phrase aimed at minimising state sovereignty</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: Implies institutions are merely management bodies shared by ethnic groups, not bodies of a sovereign state.</p>

<p class="wp-block-paragraph">European/international meaning: Institutions of the state are not “joint” but unitary bodies of state sovereignty.</p>



<p class="wp-block-paragraph">Consequences: Encourages secessionist narratives.</p>

<p class="wp-block-paragraph">Hegemonic meaning: A euphemistic term used to describe forceful removal of population belonging to a particular ethnic or religious group as a technical or administrative process.&nbsp;</p>



<p class="wp-block-paragraph">Function in the power structure: Normalises extreme violence, depersonalises victims, and suspends moral and legal responsibility of the perpetrators.</p>



<p class="wp-block-paragraph">European/international meaning: Forcible displacement and persecution of population constitutes a war crime and crime against humanity under international law.</p>



<p class="wp-block-paragraph">Consequences: Symbolic violence, legitimisation of war crimes, revisionism. Use as proposed in line with democratic standards:</p>



<p class="wp-block-paragraph">Using term ‘ETHNIC PERSECUTION’ which names the act of crime, responsibility and intention.</p>



<p class="wp-block-paragraph">73. <strong>Victim of war crimes and genocide</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: The use of the term ‘died’ instead of ‘killed’ introduces the semantic of an accident and removes the responsibility of the perpetrators. Function in the power structure:&nbsp; Depersonalises the victim and dilutes the nature of the crime. European/international meaning: A victim of war crime and genocide is a person against whom deliberate, targeted and organised violence has been committed, in violation of the norms of international humanitarian law. Consequences: euphemisation of the crime, loss of truth, and moral relativisation. Use as proposed in line with democratic standards: Consistently using the term ‘murdered victim’, and insisting on perpetrators and responsibility.</p>



<p class="wp-block-paragraph">74. <strong>Bosnian (prefix)</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: Systemic removal of the prefix ‘Bosnian’ as an allegedly administrative decision.</p>



<p class="wp-block-paragraph">Function in the power of structure: Discursive expropriation of space and erasure of historical continuity.</p>



<p class="wp-block-paragraph">European/ international meaning: Toponyms are part of the cultural, legal and identity continuity of a sovereign state in the international order of states.</p>



<p class="wp-block-paragraph">Consequences: Memory violence, discouraging return, normalising ethnic homogeneity.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: Insisting on the return of the prefix ‘Bosnian’ and pre-war names.</p>



<p class="wp-block-paragraph">75. ”<strong>International protectorate</strong><strong>”</strong><strong> (discrediting use)</strong></p>



<p class="wp-block-paragraph">Hegemonic meaning: The term is used to delegitimise the role of international institutions and mechanisms in Bosnia and Herzegovina.</p>



<p class="wp-block-paragraph">Function in the power structure: Weakening the institutional protection of the state and strengthening ethnopolitical autonomy.</p>



<p class="wp-block-paragraph">European/international meaning: The international presence has a mandate to preserve peace, law and the constitutional order of a sovereign state.</p>



<p class="wp-block-paragraph">Consequences: erosion of trust in institutions, strengthening separatist narratives.</p>



<p class="wp-block-paragraph">Use as proposed in line with democratic standards: To precisely distinguish international oversight from state sovereignty.</p>



<p class="wp-block-paragraph">76. <strong>UN General Assembly Resolution on SREBRENICA (2024) &#8211; Discoursive function&nbsp; </strong>Hegemonic meaning: Attempts to relativize or reduce the resolution to a symbolic act without effect.</p>

<p class="wp-block-paragraph">European Future of Bosnia and Herzegovina</p>



<p class="wp-block-paragraph"><strong>Mostar, 28 February 2026</strong></p>



<p class="wp-block-paragraph"><strong>THE MOSTAR DECLARATION</strong><br />On the Democratic Development and European Future of Bosnia and Herzegovina</p>



<p class="wp-block-paragraph"><strong>Starting from </strong>the indisputable millennia-long existence of our country, and its territorial and state-legal continuity;</p>



<p class="wp-block-paragraph"><strong>Having in mind</strong> the decisive expression of the citizens’ will in favor of independence of Bosnia and Herzegovina at the Referendum of 1 March 1992, by which they plebiscitarily opted for an independent, sovereign and united state, and noting that on 22 May 1992 Bosnia and Herzegovina became a full member of the United Nations and thereby acquired full international legal personality and subjectivity equivalent to that of all other UN member states;</p>



<p class="wp-block-paragraph"><strong>Underlining </strong>that Annex IV of the Dayton Peace Agreement &#8211; the Constitution of Bosnia and Herzegovina &#8211; unequivocally confirmed the legal continuity of the Republic of Bosnia and Herzegovina through a new constitutional structure which contains two entities, without any right of secession for either entity;</p>



<p class="wp-block-paragraph"><strong>Warning against</strong> the ill-intentioned and erroneous translation and interpretation of the constitutional term <strong>“constituent” (a part of the whole)</strong> as <strong>“constitutive” (an element upon which the existence of the whole depends)</strong>, since the latter is a term that does not appear in the Constitution and it has been used with the aim of misleading the public and undermining the constitutional order. It is true that <strong>the constituent peoples (Bosniaks, Croats, and Serbs)</strong> are neither the sole bearers of sovereignty, nor do they possess any exclusive sources of sovereignty. Consequently, specific peoples as such cannot negotiate, as sovereignty belongs to the State of Bosnia and Herzegovina and, by extension, to all its citizens.</p>



<p class="wp-block-paragraph"><strong>Reminding of</strong> the experience of citizens that the armed aggression against the Republic of Bosnia and Herzegovina forcibly imposed an ethno-political model of governance characterized by discrimination and apartheid against democracy, whose symbolic and actual illustrations include Stolac, Srebrenica, Prijedor, and other local communities;</p>



<p class="wp-block-paragraph"><strong>Recognizing </strong>the candidate status of Bosnia and Herzegovina for membership in the European Union, and affirming that its democratic and European path is possible only through deep constitutional and institutional reforms;</p>



<p class="wp-block-paragraph"><strong>Acknowledging </strong>that Bosnia and Herzegovina is a state of all its citizens and that the current constitutional and legal order does not guarantee equality before the law or equal access to the exercise of human rights;</p>



<p class="wp-block-paragraph"><strong>Witnessing</strong> that the constitutional order of Bosnia and Herzegovina has been openly and continuously challenged by ethnic and nationalist policies seeking to portray the country as an inherently impossible community organized solely on tribal principles;</p>



<p class="wp-block-paragraph"><strong>Having in mind</strong> the obligation of Bosnia and Herzegovina to respect and implement the judgments of the European Court for Human Rights;</p>



<p class="wp-block-paragraph"><strong>Following </strong>the unequivocal will of the citizens of Bosnia and Herzegovina for democratic, peaceful and stable development of their homeland, Bosnia and Herzegovina;</p>



<p class="wp-block-paragraph">We, the signatories of this Declaration – the Association of Independent Intellectuals Circle 99, the Youth Forum, and the Neretva Forum &#8211; hereby declare the following:</p>



<ol class="wp-block-list">
<li>The reform of the Constitution and electoral legislation of Bosnia and Herzegovina must lead to the establishment of a society of equal citizens, in accordance with the European Convention on Human Rights and the standards of the Council of Europe.</li>



<li>Ethnicization of political rights and state institutions contradicts the fundamental principles of democratic legitimacy, political equality, and individual rights, and undermines the country’s long-term stability. Elected representatives are obliged to act in the interest of all citizens, and not exclusively in the interest of any ethnic, religious, or party group.</li>



<li>Bosnia and Herzegovina cannot be permanently organized as a system of ethnic distribution of political power. Instead, it must be organized as a democratic state in which all citizens are equal before the law and enjoy equal political rights, including the right to participate in the election of all public officials whose decisions directly affect their lives and rights.</li>



<li>Each citizen of Bosnia and Herzegovina should have the right to elect each member and to be elected as a member of the Presidency of Bosnia and Herzegovina, since the decisions of each member of the Presidency have equal constitutional and legal effect and produce immediate consequences for all citizens, regardless of their ethnic, religious, or other affiliation. The exclusion of citizens who do not identify with any so-called “constituent” peoples constitutes discrimination, as confirmed unequivocally by the judgments of the European Court of Human Rights.</li>



<li>Implementation of the judgments of the European Court for Human Rights and the Constitutional Court of Bosnia and Herzegovina is not a political question but represents a constitutional and international legal obligation of Bosnia and Herzegovina, and it is a key condition for progress of the country on its European and democratic path. Non-implementation of these judgments represents an anti-constitutional practice, which has a form of a silent <em>coup d’état</em>.</li>



<li>Members of the Presidency of Bosnia and Herzegovina, in accordance with the current Constitution, are not ethnic representatives but elected state officials accountable to all citizens. Considering realistic timeframes, the general elections in 2026 should be conducted under existing legislation, accompanied by a clear commitment to ensure that by the elections of 2030 a single President of Bosnia and Herzegovina may be elected across the entire territory of the State.</li>



<li>At elections, citizens elect their political representatives according to their personal convictions. The disputable claim that a citizen who votes for a candidate from another ethnic group thereby “elects a member of the Presidency to another ethnic group” constitutes an ill-intended and anti-constitutional interpretation of democratic voting rights.</li>



<li>Anti-Bosnian and anti-European policies supported by neighboring hegemonic projects, previously sentenced for war crimes, joint criminal enterprises, and genocide, pose a direct threat to the survival of Bosnia and Herzegovina and must be countered through clear and decisive pro-state politics.</li>



<li>We firmly condemn the denial of judgments concerning genocide and war crimes, as well as attempts to reaffirm previously sentenced policies of secession, para-states, and ethnic-based territorial fragmentation through federalization or consociational models, which serve as euphemisms for further disintegration and dissolution of the state of Bosnia and Herzegovina.</li>



<li>To ensure that all citizens of Bosnia and Herzegovina enjoy peace and prosperity in their homeland, it is necessary for all political structures to give priority to the state of Bosnia and Herzegovina, while respecting the historical experience in which rigid “take it or leave it” or “either-or” approaches have proven unproductive and incapable of delivering progress, whereas an inclusive “both-and” approach has the potential to do so.</li>
</ol>



<p class="wp-block-paragraph"><strong>Through this Declaration we hereby affirm our full commitment to a democratic, rule-of-law-based, and European state of Bosnia and Herzegovina, as a country of equal citizens and a shared future.</strong></p>

<p class="wp-block-paragraph">Sinoć, u subotu 21. juna, u Bihaću je održana Konvencija „Bosna je Bosanska“. Na Konvenciji su učestvovali akteri iz Kruga 99 i političke, akademske i građanske javnosti Unsko &#8211; sanskog kantona i grada Bihaća. Na manifestaciji je iskazivana puna podrška i odlučnost za izgradnju moderne,&nbsp; demokratske, evropske i republikanske države Bosne i Hercegovine. Razmatran je i Nacrt Reforme Ustava na građanskim demokratskim principima i istaknuti prijedlozi za njegovo dalje profiliranje. Na konvenciji je usvojena:</p>



<p class="wp-block-paragraph"><strong>IZJAVA KONVENCIJE UNSKO- SANSKOG KANTONA „BOSNA JE BOSANSKA “</strong></p>



<ol class="wp-block-list">
<li>Konvencija je održana u znaku nadstranačkog političkog jedinstva građana, pijeteta i odgovornosti svih uključenih subjekata, predstavnika akademske zajednice, nevladinih organizacija, političkih stranaka i građana, za napredak države, slobodu i ravnopravnost svih ljudi Bosne i Hercegovine.</li>



<li>Tradicija hrabre odbrane cjelovite bosanske države na zapadnim granicama, Bosanske Krajine, na Konvenciji je potvrđena, sa podjednakom nepokolebljivošću, odlučnošću i spremnošću za borbu u svim okolnostima i svim sredstvima koje izazovi vremena budu nametali.</li>



<li>Konvencija izražava najveću vjernost obnovi višestoljetne bosanske države, ali insistira na daljem demokratskom razvoju primjereno novim historijskim okolnostima demokracije i modernom evropskom &#8211; građanskom konceptu države. <em>Republika</em> Bosna i Hercegovina je format političkog uređenja kojem nužno moramo težiti, a koji garantuje prosperitetnu budućnost, mir i stabilnost za sve njene građane.</li>



<li>Koliko god da bude trnovit put izgradnje slobodne države i obnove <em>inkluzivnog društva </em>ne smije se odustati od konačnog skidanja nametnutih <em>etničkih okova</em>  i tretmana BiH kao „<em>posebnog slučaja“.</em> Nećemo graditi državu mimo standarda razvijenih demokratskih država svijeta. Reforma Ustava na <em>republikanskim, građanskim demokratskim principima</em> jeste pouzdan put i jasan cilj.</li>



<li>Konvencija insistira na: dosljednoj implementaciji svih <em>šest presuda</em> Evropskog suda za ljudska prava; ukidanju svih oblika <em>diskriminacije</em> na teritoriji cijele države; stavljanje građanina kao pojedinca u fokus ustavno-pravnog sistema i jačanje institucija države Bosne i Hercegovine. To je put  izgradnje moderne <em>bosanske građanske nacionalne države </em>&#8211; koja nije u suprotnosti sa postojećim kulturnim identitetima, etničkim, narodnim opredjeljenjima, nego ih sve objedinjuje. <em>Bosanska nacija</em> je historijska i savremena politička činjenica priznata u Ujedinjenim nacijama.  </li>



<li>Konvencija traži <em>ukidanje specijalnih i paralelnih veza Srbije i Hrvatske</em> sa etničkim grupama i entitetima. Specijalne i paralelne veze su instrument urušavanja suvereniteta države Bosne i Hercegovine i realizacije velikodržavnih ambicija susjednih država.</li>



<li>Konvencija odbacuje <em>politiku stalnih ustupaka</em> rušiteljima države, sljedbenicima udruženih zločinačkih poduhvata na Republiku BiH (1992-1995).  Necivilizacijski princip <em>„dogovora naroda“</em> pokazao je razarajuću moć u proteklih više od trideset (30) godina i mora biti odbačen u političkom životu. Državotvorne političke snage moraju energično odbaciti politiku trulih kompromisa na račun državnog integriteta. To se može postići ofanzivnom borbom i ubjedljivom argumentacijom moderne demokracije.</li>



<li>Konvencija ističe da je odgovor na aktuelnu sigurnosnu krizu prvorazredno političko pitanje na koje se mora dati realan i praktičan odgovor. To se može postići predupređenjem svih kriznih situacija izgradnjom sistema polazeći od građana, od osnovnih ka višim strukturama vlasti i institucijama države.</li>



<li>Konvencija upozorava sve donosioce odluka na potrebu i nužnost izgradnje strategije <em>povezivanja države od istoka ka zapadu</em>, od Višegrada do Bihaća,  u saobraćajnom, kulturnom, obrazovnom, ekonomskom i  svakom drugom smislu, što do sada nije bilo prepoznato u javnim politikama Bosne i Hercegovine.  </li>

March 2025 &#8211; 58</strong><br /><br /> <strong> </strong>               <strong>Statement of Krug 99 on the Return to the Constitution of the Republic of Bosnia and Herzegovina</strong><br />   The decades-long, incremental separatist strategy of undermining the state of Bosnia and Herzegovina, along with the demolition of the existing constitutional order and the Dayton Peace Agreement in its entirety, has undoubtedly reached an overt and aggressive phase of accelerated and blatant secession of the entity Republika Srpska from Bosnia and Herzegovina. The recent adoption of the laws that undermine the fundamental instruments and institutions of a sovereign state underscores this separatist goal.<br />   Milorad Dodik’s government has abandoned the Dayton Peace Agreement (DPA). Despite rulings of the Constitutional Court of Bosnia and Herzegovina, the positions of numerous international actors, as well as witnesses to the DPA, the creation of a de facto state of institutional paralysis and conflict threatens to escalate into armed conflict.<br />   Such a state of affairs is not in the interest of any reasonable citizen or any well-intentioned resident of Bosnia and Herzegovina! It is imperative that we acknowledge that the division of our country into two entities has proven to be a failed experiment. Furthermore, that division has been the cause of the  destruction of our society as it has rendered the state dysfunctional.<br />   The concept of a state of Bosnia and Herzegovina comprised of two entities and three constituent peoples has been and continues to be a formula not only for ethnic division within the country but also one that encourages the expansionist ethno-territorial aspirations and hegemonism of both Serbia and Croatia.<br />   This situation must change! Faced with a choice between peace and a renewed armed conflict, we have the right to seek a different constitutional and territorial organization for Bosnia and Herzegovina, as the previous one has failed.<br />   A solution to this situation is envisioned by virtue of a return to the Constitution of the Republic of Bosnia and Herzegovina. The right to reinstate that Constitution was legitimized  by the adoption of the Constitutional Law on Amendments to the Constitution of the Republic of Bosnia and Herzegovina on December 12, 1995, and was voted on by the legal Assembly of the Republic of Bosnia and Herzegovina.<br />   Article 1 of the Constitution states that the Republic of Bosnia and Herzegovina, exercising its sovereign rights, may change its internal organization in accordance with the Constitution of Bosnia and Herzegovina, within the framework of the International Peace Agreement for Bosnia and Herzegovina.<br />   Furthermore, Article 2 of the same Law clearly defines the solution and obligations in case of a possible failure to abide by the Dayton Peace Agreement, as in the current situation. In such circumstances, if “the International Peace Agreement and its Constitution of Bosnia and Herzegovina are not being implemented,” the Republic of Bosnia and Herzegovina may declare the International Peace Agreement for Bosnia and Herzegovina null and void and proceed as an internationally recognized, sovereign, and independent state, as outlined in the Constitution of <em>the Republic</em> of Bosnia and Herzegovina.<br />   Krug 99 urges the current members of the Parliamentary Assembly of Bosnia and Herzegovina, existing as a continuation of the Parliamentary Assembly of the Republic of Bosnia and Herzegovina, to appropriately analyze the current state of affairs involving the effective withdrawal of Republika Srpska from the Dayton Peace Agreement in Bosnia and Herzegovina. March 2025 &#8211; 57</strong> <strong> </strong>               <br />        Far from the public eye in Bosnia and Herzegovina, two mutually synonymous, if not identical, processes are taking place &#8211; the intensive colonization of the Republika Srpska, and the certainly irreversible colonization of Herzegovina.<br />       The real masters and protagonists of this colonization are, on the one hand, Viktor Orban, Trump's &#8220;envoy to Europe&#8221;, and, on the other hand, Amir Gross Kabiri, Benjamin Netanyahu's &#8220;Zionist envoy and commissioner&#8221; for Bosnia and Herzegovina.<br />       The two most loyal allies of these protagonists are &#8211; Dodik, who uses national Serbian interests as a cover for all acts of economic &#8220;enslavement&#8221;, and, on the other hand, Čović, who uses national Croatian interests as a cover for all acts of economic and political &#8220;enslavement&#8221; and colonization. Dodik's most loyal followers believe that they are working for the interests of the &#8220;Serbian public&#8221; but, in reality, are working for the interests of Orban and his vision of turning Hungary into a major European powerhouse with ambitions to regain the territories lost after the defeat in WW2. In his vision of a &#8220;new Hungary&#8221;, Orban relies on Republika Srpska’s pool of mineral resources. The findings of the Swiss company &#8220;Arcore AG&#8221; from the summer of 2023 showed that just in Lopari, located on the slopes of Majevica one can find 1.5 million tons of lithium, 14 million tons of boric acid, 35 million tons of potassium, and 94 million tons of magnesium. The total value of these deposits exceeds a remarkable &#8211; 15 billion euros.<br />       The Hungarian press reports Orban's statement that Hungary, with lithium reserves from the Republic of Srpska, would be among the four leading global powers in the production of this &#8220;white gold&#8221; immediately following China, the USA and Germany.<br />       The process of colonization began with the first meeting of Dodik and Orban in April 2019, and was especially intensified during 2022 and 2023, when comprehensive research was completed and several other pools of mineral wealth were discovered.<br />       The Hungarian press reported the words of Prime Minister Višković, who on this occasion conveyed: &#8220;In the coming period, together with our economic partners, we will be able to start exploiting the mineral resources located in the areas of Ozren, Lopare, Jezero, Mrkonjić Grad, Rudo, Čajniče and Zvornik.”<br />         <strong>How Orban bought Milorad Dodik's trust.</strong><br />         The Hungarian press writes about the first loan of 35 million euros which was granted as part of a &#8220;program to help the people of Bosnia and Herzegovina&#8221; but the program’s core essence was to ensure the victory of Dodik in the October 2022 elections. The second, incredibly favorable loan in the amount of 110 million euros Hungary granted in the fall of 2023 when the Republic of Srpska was on the verge of bankruptcy, as stated by Zora Vidović, Minister of Finance for the Hungarian press.<br />       When Germany canceled all projects in the Republic of Srpska worth 120 million euros in 2022/3, Hungary stepped in with a promise to implement all these projects with its own money. The Hungarian press also tells us about new investments made in 2024 worth 140 million euros for several different projects, from &#8220;waste management&#8221; to &#8220;energy projects&#8221; in Hrgud&#8230; The same Hungarian sources write about secret deals made through the Republic of Srpska power utility, Elektroprivreda when the Hungarians, far from the public eye, bought a 70% ownership stake in the largest Balkan Solar Power Plant Trebinje. Hungary plans to invest an additional half a billion euros in the next year, 2026, in the exploitation of the Republika Srpska's mineral resources.<br />       Behind all the threats, including the latest ones against Bosnia and Herzegovina that we recently heard from the high-ranking Hungarian diplomat, is actually Orban's imperialist dream of colonizing Republika Srpska.       Orban wants to complete the job via a personal union with Dodik, and for this reason, Bosnia and Herzegovina as a whole country with its own institutions is the biggest obstacle and hindrance in his obsessive ambition to create a great and powerful Hungary on the European soil.<br />       Because of his imperial ambitions, Orban has an obsessive desire to divide Bosnia and Herzegovina.       That Orban stands behind the division of BiH is also evidenced by the fact that he, together with Janez Janša, was one of the authors of a new 2021 map dividing Bosnia and Herzegovina, where the country would belong partially to Croatia and partially to Serbia. The remainder of Bosniaks would become completely irrelevant. Orban's authorship of the new map of BiH division becomes even more convincing insofar as he advocates not for multi-ethnic, but for ethno-national states. Orban needs Dodik to help him neutralize the defeat of Hungary in WW2 and to realize his skillfully hidden plans of creating a &#8220;great and strong Hungary&#8221;, but, above all, he needs Republika Srpska’s &#8220;mineral pool&#8221; and that is why he pays Dodik so generously, that is why he repeatedly put him on his feet saving Dodik's regime from bankruptcy in the summer of 2023 with an incredible loan of 110 million euros.<br />       Orban is also the key director of the recent drama involving the Hungarian military and police forces in Banja Luka, where he wanted to present Bosnia and Herzegovina as Trump presented Zelensky in the Oval Office. This Oval Office drama had its European implications and, carried far-reaching lessons about trust in “European security forces.” <br />      Orban will not stop here, just as he will not give up on buying Milorad Dodik's regime with new millions of euros. <br />  ** <br /><strong>Presenters at the “Krug 99” session of 9 March 2025. <figure class="wp-block-table"><table><tbody><tr><td></td></tr><tr><td><strong>Krug 99, Sarajevo</strong> <br /><strong>Rezime sesije 17.03.2024.-54</strong>   <br /><br /><strong>Univerzalni principi i bosanska stvarnost</strong><br /><br /> <strong> </strong> <em>          Sva bića rađaju se slobodna i jednaka u dostojanstvu i pravima, </em>stoji u članu 1. Univerzalne deklaracije o ljudskim pravima UN-a. Ova rezolucija poslužila je kao temelj za donošenje novog internacionalnog ugovora – Evropske konvencije o zaštiti ljudskih prava i osnovnih sloboda sa svim njenim Protokolima. Konvencija je, kao takva, sastavni dio Ustava BiH, a ratifikovana je 1997. godine.           Konvencijom je ustanovljen <a href="https://hr.wikipedia.org/wiki/Europski_sud_za_ljudska_prava">Evropski sud za ljudska prava</a> u <a href="https://hr.wikipedia.org/wiki/Strasbourg">Strasbourgu</a> (čl. 19.). Države potpisnice Konvencije obvezuju se da će se podvrgnuti konačnoj presudi Evropskog suda u svakom sporu u kojem su stranke, a odgovornost za primjenu Konvencije, uz Sud, dijeli <a href="https://hr.wikipedia.org/w/index.php?title=Odbor_ministara_Vije%C4%87a_Europe&amp;action=edit&amp;redlink=1">Odbor ministara</a>, koji je nadležan za nadzor nad izvršenjem presuda Evropskog suda. U slučaju upornog i dosljednog odbijanja izvršenja presuda, Odbor ministara nadležan za nadzor nad izvršenjem presuda ESLJP može da posegne za radikalnim prijedlogom, kao krajnjom mjerom, a to je <strong>isključenje BiH iz Vijeća Evrope!</strong>           Dakle, pravno gledano ne postoji niti smije biti bilo kakva prepreka u provođenju svih presuda iz grupacije predmeta ‘’Sejdić-Finci’’. U julu ove godine će biti punih 10 godina od donošenja presude u predmetu ‘’Zornić vs. BiH’’. Svih ovih 10 godina etnonacionalšovinisti svojim političkim djelovanjem, bolje rečeno, zloupotrebom svoje političke moći uz svesrdnu pomoć susjeda iz Hrvatske i Srbije, koje pretenduju na suverenitet i teritorijalni integritet BiH, sprečavaju svaki pokušaj provedbe ovih presuda. Čak i Kristijan Šmit, u ulozi visokog predstavnika nadležnog za civilni aspekt Dejtonskog mirovnog sporazuma, zloupotrebljava svoju poziciju te, po nalogu Plenkovića, opstruira svaki pokušaj implementacije presuda. On čak i ne pokušava prikriti svoj servilni odnos prema premijeru RH, dapače, na stranici OHR-a i u medijima se hvali svojim podaničkim odnosom prema Plenkoviću i Vučiću. Da li je došlo vrijeme da se imenuje novi visoki predstavnik koji će u punom kapacitetu obnašati tu dužnost u korist BiH i svih njenih građana?<br />           Svi građani BiH, isto kao i građani bilo koje evropske države, zaslužuju pravo na bosanski nacionalni identitet bez etničke ili bilo koje druge pripadnosti, jer je to lični i privatni izbor svakog pojedinca naše domovine.<br />           Svi <strong>spinovi o napredovanju</strong> BiH na putu ka punopravnom članstvu u EU imaju za cilj predizbornu kampanju kako europarlamentaraca u junu ove godine tako i domaćih političara koji se pripremaju na ovaj način za oktobarske općinske izbore.<br />           Iako je najava preporuke za otvaranje pregovora o pristupanju EU za pozdraviti, ipak se pristup Bosne i Hercegovine EU treba tretirati i ubrzati kao pitanje restorativne pravde kako bi se “popravila šteta” ili “ispravila nepravda” koja je učinjena Bosni, kao žrtvi ratnih zločina koje su inicirali udruženi zločinački poduhvati vođeni istim principima i u Srbiji i u Hrvatskoj. Ovi udruženi zločinački poduhvati imali su za cilj geografsku teritoriju za stvaranje “Velike Srbije” i “Herceg-Bosne”, kao dio eliminacijskih poduhvata sličnih nacionalsocijalističkoj ideologiji <em>lebsensrauma</em> koja je opravdavala teritorijalno osvajanje i eliminaciju stanovništva. Internacionalna zajednica treba prepoznati svoju odgovornost za nesprečavanje navedenih zločina koji potiču iz Beograda i Zagreba.<br />           Najava predsjednice Evropske komisije Ursule von der Leyen da “Komisija preporučuje Vijeću da otvori pristupne pregovore sa Bosnom i Hercegovinom” u očekivanju “daljnjih koraka” izgleda samo odgađa proces koji bi trebao biti tretiran sa većim osjećajem hitnosti.<br />           Član 1. postojećeg Sporazuma o stabilizaciji i pridruživanju odnosi se na jačanje demokratije i vladavinu prava. Iako su presude Evropskog suda za ljudska prava zaista pozivale na „demokratske aranžmane bez odlaganja“, Bosna nije dobila podršku u tom pogledu. Očigledna zabrinutost vezana za Putinov vanjskopolitički cilj da ujedini “bratske narode” i strateški odnos Milorada Dodika sa Putinom je da bi entitet Republika Srpska mogao postati još jedan Donbas. Republika Srpska već služi kao prva linija otpora prema EU i NATO-u. <figure class="wp-block-table"><table><tbody><tr><td></td></tr><tr><td><strong>Krug 99 (Circle 99)</strong> <strong>Sarajevo, Bosnia and Herzegovina</strong><br /><strong>Summary of the session 17.03.2024.-54</strong> <br /> <br /> <strong>Universal principles and Bosnian reality</strong><br /><br /> <strong> </strong>           All human beings are born free and equal in dignity and rights, states Article 1 of the UN Universal Declaration of Human Rights. This resolution is recognized as having inspired, and paved the way for, the adoption international human rights treaty, applied today on a permanent basis at global and regional levels &#8211; the European Convention on the Protection of Human Rights and Fundamental Freedoms with all its Protocols. As such, the Convention is an integral part of the Constitution of BiH, and it was ratified in 1997. The Convention established the European Court of Human Rights in Strasbourg (Art. 19). The High Contracting Parties undertake to abide by the final judgment of the Court in any case to which they are parties. The responsibility for the application of the Convention, along with the Court, is shared by the Committee of Ministers of the Council of Europe, which is responsible for monitoring the execution of judgments of the European Court. In the case of persistent and consistent refusal to enforce judgments, the Committee of Ministers can resort to a radical proposal, as a last resort, which is the exclusion of Bosnia and Herzegovina from the Council of Europe!           Therefore, from a legal point of view, there is not and should not be any obstacle in the implementation of all judgments from the &#8220;Sejdić-Finci&#8221; case law. In July of this year, it will be 10 years since the verdict in the case &#8220;Zornić vs. Bosnia and Herzegovina&#8221;. For all these 10 years, the ethno-national chauvinists have prevented any attempt to implement these judgments through their political activities, or better said, by abusing their political power with the wholehearted help of their neighbors from Croatia and Serbia, who pretend to the sovereignty and territorial integrity of BiH.<br />           Even Christian Schmidt, in the role of high representative responsible for the civilian aspect of the Dayton Peace Agreement, abuses his position and, on Plenković's order, obstructs every attempt to implement the judgments. He does not even try to hide his servile attitude towards the Prime Minister of the Republic of Croatia, in fact, on the OHR website and in the media, he boasts of his servile attitude towards Plenković and Vučić. Has the time come to appoint a new high representative who will perform this duty in full capacity for the benefit of BiH and all its citizens?<br />           All citizens of BiH, just like citizens of any European country, deserve the right to a Bosnian national identity without ethnic or any other affiliation, because it is a personal and private choice of every individual of our homeland.<br />           All spins about BiH's progress on the way to full membership in the EU are aimed at the pre- election campaign of both MEPs in June this year and local politicians who are preparing in this way for the October municipal elections.<br />           Although the announcement of the recommendation for the opening of EU accession negotiations is to be welcomed, Bosnia and Herzegovina's accession to the EU should be addressed and expedited as a matter of restorative justice in order to “repair the harm,” or “right the wrong” that has been done to Bosnia., as a victim of war crimes initiated by Joint Criminal Enterprises led by principles in both Serbia and Croatia. These Joint Criminal Enterprises sought geographic territory, whether “Greater Serbia” or “Herceg Bosna” as part of <em>eliminationist</em> enterprises not unlike the National Socialist ideology of <em>lebsensraum</em> that justified territorial conquest and the elimination of the population. The international community should recognize its responsibility for failing to prevent the crimes originating in Belgrade and Zagreb.<br />           The announcement by President of the European Commission, Ursula von der Leyen that “the Commission recommends to the Council to open accession negotiations with Bosnia and Herzegovina” pending “further steps” seems only to delay a process that should rather be treated with greater urgency.<br />           Article 1 of the existing Stabilization and Association Agreement refers to the goal of supporting “efforts of Bosnia and Herzegovina to strengthen democracy and the rule of law”. Yet while the ECHR judgements have indeed called for “democratic arrangements without delay,” Bosnia has not been supported in this regard.  The obvious concern related to Putin’s foreign policy goal to unify “brother peoples”, and Milorad Dodik’s strategic relation with Putin, is that the entity Republika Srpska could become another Donbas. <figure class="wp-block-table"><table><tbody><tr><td></td></tr><tr><td><strong>Krug 99, Sarajevo <br />Rezime sesije 10. marta 2024. – 53 </strong><br />  <br /><strong>Ne/zavisnost pravnog sistema, moral i kompetencije</strong>               <br /><br />Moderna demokratska država, pa i Bosna i Hercegovina u skladu sa Ustavom Bosne i Hercegovine, počiva na principima pravne države i vladavine zakona. Da proklamovani ustavni princip ne bi ostao puko „slovo na papiru“ neophodno je da funkcioniše dioba vlasti na zakonodavnu, izvršnu i pravosudnu. Prvi neispunjeni preduslov za ravnotežu tri grane vlasti, koji onemogućava nezavisnost pravosudnog sistema, se ogleda u tome da samo pravosudna vlast nije dio Ustava Bosne i Hercegovine, iako je to suprotno međunarodnim standardima.<br />             Postojeća percepcija o ugroženosti nezavisnog pravnog i pravosudnog sistema, ali i relevantni međunarodni stručni izvještaji ukazuju na niz slabosti koje su povezane sa problemom nezavisnosti, morala i kompetencija u sistemu.<br />             Izostanak prevencije i sistemskog unapređenja slabosti u našem društvu koje je zajedničko svim oblastima od javnog interesa, počiva na bavljenju isključivo posljedicama, a ne uzrocima problema. Svjedočimo višedecenijskom bavljenju isključivo poraznim individualnim primjerima, nerijetko tragičnim, koji su samo posljedica sistemskih slabosti. Tragični primjeri, primjera radi: saobraćajnih nesreća sa smrtnim posljedicama zbog obijesne vožnje, porodičnog nasilja sa smrtnim posljedicama, neodgovornog upravljanja javnim resursima, u pravilu ne vode ka široj javnoj raspravi uzroka takvih tragičnih posljedica, što bi u konačnici u demokratskim pravnim državama moralo voditi ka izmjeni propisa, praksi ili jačanju represivnog državnog aparata.<br />             Takvo stanje beznađa počiva na odsustvu odgovornosti u svim oblastima bosanskohercegovačkog društva i višedecenijskom njegovanju kriterija mediokritetstva nauštrb meritokratije (podobni a ne sposobni).<br />             Odsustvo odgovornosti ima posljedice i po nezavisnost, moral i kompetencije i pravnog i pravosudnog sistema. Nefunkcionalna zakonodavna i izvršna vlast koje su ovlaštene za donošenje zakona, kojima se uređuju društveni odnosi, uvjetuju da društvo permanentno „tavori u mjestu“ i da svjedočimo ponavljanju posljedica. Takvo neodgovorno obnašanje pozicije vlasti koja bi trebala da djeluje „od naroda i u ime naroda“ se sistemom međusobno povezanih posuda manifestuje i u svim drugim oblastima, pa i pravosudnoj.<br />             Za nezavisnost pravosuđa je ključno da se zakonom osiguraju i zadrže principi odvojenosti pravosuđa od zakonodavne i izvršne vlasti, da se osigura finansijska nezavisnost i adekvatna plaćenost za rad, imenovanje nosilaca pravosudne funkcije od regulatornog pravosudnog tijela i da postupak imenovanja i napredovanja počiva na objektivno mjerljivim kvalitativnim kriterijima, da nosioci pravosudnih funkcija imaju punu samostalnost u radu, i da se uspostavi vjerodostojan sistem odgovornosti nosilaca pravosudne funkcije za rad koji osigurava povjerenje javnosti u integritet.             Pa koji je onda uzrok problema, ako je nesporno većina naprijed navedenih kriterija za nezavisnost ispunjena? Prije svega, kvalitet i kompetencije nisu jedino mjerilo pri selekciji. U Bosni i Hercegovini, kriterij kvaliteta za imenovanje i napredovanje se, kao i u većini oblasti javnog života, kombinuje sa podjednako značajnim elementom etničke pripadnosti. Takav pristup djeluje destimulirajuće za vrhunske stručnjake.<br />             Drugo, kvalitet i kompetencije su uvjetovane i stečenim predznanjem koje se provjerava na pravosudnim ispitima i na pravnim fakultetima. O kompetencijama i moralu pravnog i pravosudnog sistema, ponešto kazuje činjenica da ministri pravde koji su nosioci izvršne vlasti i koji nužno nisu niti pravnici, u cijelosti odlučuju o konceptu pravosudnog ispita, o programu ispita i ispitivačima koji će provoditi ispit. O kvalitetima pravnih fakulteta ponešto kazuju i zvanične međunarodne rang liste univerziteta, a ponajviše činjenica odsustva sticanja praktičnih znanja tokom studija. Sve to uvjetuje u konačnici kvalitet budućih nosilaca pravosudnih funkcija, uključujući u širem smislu i advokate, pravobranioce&#8230;<br />             Treće, postoji opasnost da se nezavisnost sistema, u krhkom demokratskom društvu primijeni kao odsustvo odgovornosti i izolovanost od obaveze prema državi i društvu, zbog kojeg se i uspostavlja pravni pa i pravosudni sistem.<br />             To prije svega znači da je nadzorna uloga javnosti, pa i medija, i glas kritike stručne javnosti izražen u pisanim stručnim radovima, javnim istupima, medijskim tekstovima, ali koji počiva na odgovornom i objektivno utemeljnom osnovu za raspravu, put ka katarzi sistema.<br />             I dok su istupi koji šokiraju, uznemiravaju ali izneseni sa ciljem unapređenja sistema, uz dokazive navode ili postojanje objektivnog utemeljenja dio demokratske kulture, nedokazivi, isključivo paušalni kritizerski navodi, su također pogubni za očuvanje nezavisnosti. Naročito je problematično što se u našem društvu javni istupi i djelovanja nosilaca vlasti nerijetko koriste za direktno ugrožavanje pravnog i pravosudnog sistema, jer takva postupanja vode ka stvaranju javne slike o dozvoljenosti podrivanja autoriteta pravosudnog i pravnog sistema.<br />              Dakle, otvorenost, transparentnost u mjeri koja je moguća, stručne inkluzivne rasprave i radovi o stručnim temama i njihovo razmatranje u nadležnim tijelima u okviru sistema, proaktivni sistemski pristup preveniranju uzroka problema: od imenovanja i napredovanja, do disciplinske odgovornosti, pa i prihvatanje „budnog oka javnosti“ i razmatranje relevantnih glasova za potrebu unapređenja su putokaz ka izlazu iz stadija u kojem se društvo nalazi, a to je defetizam i beznađe.<br />             Moral u pravnom i pravosudnom sistemu, kao odraz običaja i duhovnog stanja društva nije izolovan od opšteg duhovnog stanja društva. Ipak, kako je primjena prava i pravnih normi, direktno uvjetovana osim kompetencija i moralom (etikom i integritetom) od ključnog je značaja da i taj element bude sastavni dio kako sistema koji primjenjuje pravne norme, tako i svakog pojedinca u tom sistemu. March 2024 &#8211; 53</strong> <br /><br /><strong>(IN)DEPENDENCE OF THE LEGAL SYSTEM:  MORALITY AND COMPETENCE</strong><br /><br />                A modern democratic state, which means also Bosnia and Herzegovina in accordance with its Constitution, rests on the principles of the legal state and the rule of law.  If this Constitutional principle is not to remain simply a “declaration on paper,” a division of authority is required into the legislative, executive and judiciary.  The first unfulfilled precondition for balancing the three branches of government, which runs counter to the independence of the judicial system, can be observed in the fact that only judicial authority is not part of the Bosnian Constitution, though this is contrary to international standards.<br />                  The current perception is of an endangered independent legal and judicial system, but relevant international expert analyses have pointed out a series of weaknesses connected with the issue of independence, morality and competence in the system.<br />                  Lack of preventative measures and a systematic promotion of weaknesses in our society, common in all fields of public interest, rests on a tendency to look into exclusively consequences, rather than the root causes of problems.  Witness the decades-long intensive concern about often tragic individual examples that are in fact only results of systemic weaknesses.  These are indeed tragic examples, such as:  fatal traffic accidents caused by hazardous driving, domestic family violence with fatal consequences, irresponsible management of public resources.  As a rule, such cases do not lead to a broader public discourse about the causes of such tragic incidents, which would in turn, in the legal systems of democratic countries, lead to a change in the rules, practice or a strengthening of a repressive state apparatus.<br />                  Such a hopeless situation rests on the lack of responsibility in all fields of society in Bosnia and Herzegovina, as well as on the decades-long fostering of the criteria of mediocrity at the expense of meritocracy (capable but not competent).<br />                  The lack of responsibility carries consequences for the independence, morality and competence of the legal and judicial systems.  Dysfunctional legislative and executive branches, authorized to pass laws that regulate social relations, create a society that is constantly “treading water,” so we are witness to repeated consequences.  Such irresponsible behavior on the part of the authorities that should be functioning “for the people and in the name of the people” emanates from a system of interconnected fields of activity, including the judiciary.<br />                  The key issue of an independent judiciary is that the principle of separation of the judiciary from the legislative branch of government be enshrined in law.  This would include assuring financial independence and adequate pay for work, the nominating of judicial authorities by a regulated judicial body.  And, nominating and promoting should be based on objectively qualitative criteria.  Judicial authorities should enjoy full independence in their work, and a credible system of responsibility should be established among judicial authorities for their work that would inspire the public’s confidence in their integrity.<br />                  So, what is the cause of the problems, if a majority of the above described criteria were to be adopted?  First of all, quality and competence are not the only selection standards.  In Bosnia and Herzegovina, the criterion of quality for nominating and promoting, as in a majority of cases in the public sector, is combined with the equally important factor of ethnic affiliation.  Such an approach only discourages first-class experts.<br />                  Secondly, the quality of competence is similarly conditioned on previous knowledge which is then examined at legal and judicial departments at the university level.  The fact that Ministers of Justice, who are the main factors of executive authority and who are not necessarily lawyers, are the ones who decide in its entirety the conceptualization of judicial examinations, the schedule and the process of testing, tells us a lot about the competence and morality of the legal and judicial systems.  The official international rank-listing of our universities, and even more so the lack of acquiring knowledge during the period of studies, likewise tells us something about the quality of our law schools.  In the end, all of this has an impact on the quality of future judicial authorities, including more broadly other professions, such as lawyers, prosecutors and others.<br />                  Third, there is the danger that the independence of the system, in a fragile democratic environment, can be applied as the absence of responsibility and isolation from an obligation to the state and to its citizens, which is the very reason for the establishment of a legal and judicial system in the first place.<br />                  This means that the pathway to a catharsis in the system is the watchdog role of public opinion, including the media and critical voices from experts expressed in professional journals, public fora, media writings, as long as they are based on a responsible and objectively founded basis for discussion.<br />                  Expressions of opinion that have shock value can still be published with the aim of improving the system, if they have proven contentions that are an objective foundation for a democratic culture.  On the other hand, those that are unproven, or whose contentions are only partially based on objective criteria, can be fatal for preserving independence.  It is especially problematic that in our environment public statements and activities of authority figures are often misused for the purposes of directly threatening the legal and judicial systems.  Such behavior can lead to creating a picture among the public that it is permissible to undermine the authority of the legal and judicial systems<br />.                  Finally, openness and transparency, to the extent possible, professionally inclusive discussions and articles on professional subjects and their analysis in appropriate bodies in the framework of the system, a proactive systematic approach – all of these things supersede the cause of problems.  From nominating and promoting to disciplined responsibility and acceptance of the “watchful eye of public opinion” and the analysis by relevant voices with the aim of moving forward – all this represents the pathway out of the phase in which society currently exists, which is nothing more than defeatism and hopelessness.<br />                  Morality in the legal and judicial systems, as a reflection of custom and of the spiritual condition of society, cannot be isolated from the general spiritual condition of society.  Nevertheless, since the application of justice and legal norms is directly conditioned on competence and morality (ethics and integrity), of foremost significance is that this element become an integral part not only of the system of legal norms but also of every individual in that system.<br />                  This means that implementable standards must be secured, so that they can guarantee that we do not enter into a system without objectively confirming these characteristics, which should then be constantly tested <figure class="wp-block-table"><table><tbody><tr><td></td></tr><tr><td><strong>Circle 99 – Krug 99 – Kreses 99</strong> <br /><strong>Sarajevo, Bosna i Hercegovina</strong> <br /><strong>31. januar 2024 – 52</strong> <strong> </strong><br /><br /> <strong>                 Ljudska (ne)prava i opstanak domaćeg i internacionalnog poretka</strong><br /><br />          Za BiH je od prvorazrednog i strateškog značaja primjena Evropske konvencije o ljudskim pravima (EKLJP) radi postizanja dugoročno održivog mira i stabilnosti. Konvencija je najvažnija odredba Općeg okvirnog sporazuma za mir u Bosni i Hercegovini i &#8216;ustavni instrument evropskog javnog poretka&#8217;. Samo na tim temeljima moguć je cjelokupni razvoj, napredak i izgradnja države BiH kao demokratske, pravne, ekonomske, socijalne, kulturne zajednice,  članice kako Vijeća Evrope tako i u budućnosti Evropske unije. Prioritet EKLJP nad Ustavom BiH i njenu direktnu primjenljivost  potvrdila je i Evropska komisija za demokraciju putem prava (Venecijanska komisija). <br />          Na tom osnovu je Parlamentarna skupština Vijeća Evrope utvrdila je 2006. godine „mapu puta za BiH“ u nastojanju da se i putem Venecijanske komisije  najkasnije do 2010. godine napravi novi Ustav za BiH, kao što je to uradila u brojnim državama u tranziciji nakon pada Berlinskog zida. Taj put bio bi jednostavniji, efikasniji i jeftiniji i za VE, EU, Visokog predstavnika, i samu državu BIH i njene građane. Nadležne evropske institucije nisu, a mogu iskoristiti sve raspoložive instrumente kako bi doveli do efikasnije primjene EKLJP i izvršenja svih presuda Suda za ljudska prava u BiH, uključujući i najvažniju presudu „Kovačević protiv BiH“. <br />          U protivnom, za povlađivanje etno nacionalizmu odgovorni su akteri politika  zadržavanja sadašnjeg, oktroisanog Ustava BiH, koji moraju snositi posljedice za dalje propadanje države. Rješenje je da se kroz dodjeljivanje kandidatskog statusa pristupi izvršenju presuda Evropskog suda i zajedno sa Venecijanskom komisijom usaglase odredbe Ustava BIH sa EKLJP.  Na takav način bi BiH ojačala svoje institucije u mjeri samostalnog izvršavanja obaveza i postala, kao i svaka druga članica VE, EU i NATO-a, savremena demokratska i pravna država koja štiti ljudska prava i uspješno se nosi sa svim poteškoćama modernog doba. <br />          Dosadašnje manipulacije prilikom odvijanja izbornog procesa, spore objave izbornih rezultata samo predstavlja krunu u sistemu neuređenih odnosa koji su vezani za izborni proces, a što se reflektira na birače i na njihovo nepovjerenje spram izbornog procesa. Brojni aktivni učesnici u izbornim manipulacijama nikada nisu sankcionirani, čime izostaje generalna i individualna prevencija i nužnost izmjena krivičnog zakonodavstva u toj oblasti. <br />          Provedba presuda Evropskog suda za ljudska prava moraju u konačnici  dovesti do izmjena Ustava i Izbornog zakona Bosne i Hercegovine. To je  <em>conditio sine qua non</em> efektnog i na nediskriminaciji utemeljenog izbornog sistema gdje će se u maksimalnom opsegu zagarantirati aktivna i pasivna prava svih građana bez obzira na etnički, vjerski, entitetski ili bilo kojoj drugi individualni identitet. <br />          Izmjene Izbornog zakona Bosne i Hercegovine u domenu integriteta izbornog procesa predstavljaju trenutnu i nužnu potrebu kako bi se stvarna volja birača koja je zabilježena na biračkim mjestima izrazila i u rezultatima izbora. To bi vratitlo povjerenje građana (birača) u izbore. Treba odbaciti svako  zakonsko rješenje kojim bi se uspostavila  diskriminacije pojedinaca u Bosni i Hercegovini po bilo kojem osnovu. <br />          Jasno je da su se države Internacionalnim Paktom o građanskim i političkim pravima iz 1966., obavezale na implementaciju. Ali i da su rukovodeći se vlastitim nacionalnim interesima normirali ovu materiju, no s vrlo slabim praktičnim mehanizmima zaštite, implementacije, nadzora i kontrole, te sankcioniranja onih država koje ne ispunjavaju svoje međudržavne obaveze i pri tome krše osnovna ljudska prava u svojoj nadležnosti. <br />          Ipak, za BiH je implementacija put ka trajnom miru, neovisno o tome što države današnje internacionalne zajednice vrlo često opravdaju neizvršavanje vlastitih obaveza pozivanjem na apsolutni suverenitet i načelo nemiješanja u unutrašnje poslove države. To je potpuno pogrešno shvatanje i stajalište. Ljudska prava ne pripadaju unutrašnjoj domeni uređenja – danas je njihova zaštita uređena na internacionalnom nivou, dok je suverenitet država ograničen upravo internacionalnim pravom. <br />          Ono čemu danas svjedočimo u BiH su sve češća sistemska, planska, organizirana, rasprostranjena kršenja ljudskih prava i sloboda koja uvelike poprimaju oblike najtežih zločina diskriminacije. I koje izravno ugrožavaju najvažnije vrijednosti na kojima je izgrađen mir i suvremeni internacionalni poredak. Razlozi za nedovoljan, neadekvatan i neefikasan sistem zaštite ljudskih prava leže u činjenici slabog mehanizma kontrole provođenja odluka internacionalnih sudskih i kvazi sudskih tijela, kao i u odsustvu konkretnih mjera protiv odgovornih država. <br />Ponovno je došlo vrijeme da se otvori staro pitanje reforme Ujedinjenih nacija, prvenstveno reforme Vijeće sigurnosti, kako bi moglo efektivno odgovoriti svojoj primarnoj zadaći, staranju o internacionalnom miru i sigurnosti.  <br />*** Sesija je održana u povodu Internacionalnog Dana ljudskih prava.
